How Pakistani courts decide custody and visitation, the role of the Guardians and Wards Act, and how to prepare your case.
The legal framework
Custody and guardianship of children in Pakistan are decided by the Guardian Court under the Guardians and Wards Act, 1890. The court’s guiding principle is the welfare of the minor.
How courts decide
Courts consider the child’s age and gender, the character and capacity of each parent, the child’s own wishes where they are old enough, and the stability of each home. No single factor decides the outcome.
Visitation
The parent who does not have custody is usually entitled to meet the child. Courts can set a visitation schedule, including arrangements for holidays and special occasions.
Preparing your case
Gather documents such as the children’s birth records, school reports and any evidence about their care. A calm, well-prepared case helps the court focus on what matters most: the child.
